Welcome to the FloWorks International LLC (“FloWorks”, “us”, “we” or “our”) Website.    This site is made available by FloWorks, for its benefit and that of its subsidiary and affiliate companies and any business units associated with it by virtue of the fact they are in the same common ownership. We are committed to protecting your personal information and your right to privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by FloWorks as part of the normal operation of the Website.

1. Collection of Information

We collect information that you provide directly to us, such as when you fill out forms, from our Careers page, make a purchase from our supply site or contact us.  These include such things as name, phone number, mailing address, email address, login credentials (e.g., ID), order information, and payment information from Visitors who access data (e.g., product catalogs, line cards, etc.)  and/or place orders via the Website (“Customers”). We collect information contained on resumes (“Applicants”) voluntarily uploaded or sent by Applicants, as well as any information or documentation sent to FloWorks. We also collect information contained on any Content voluntarily uploaded by Customers. 

We also collect information such as name, phone number, mailing address, email address, investor status (e.g. “accredited investor,” “qualified institutional buyer,” etc.), credit information, social security number, assets and income from Visitors applying for access to the private financial information portal (the “Secured System”) on the “Investor Relations” page of the Website (“Investors”). We also collect information contained on any documents, including the Secured Website Access Certification form, voluntarily uploaded by Investors. We use any non-public personal information, such as credit information, solely for the purpose of evaluating whether a potential Investor meets the criteria specified in the Secured Website Certification Form, a copy of which may be found at floworkspvf.com.

We use certain third-party payment processors (“Payment Processors”) to process personal financial information such as name, phone number, address, zip code, and credit card or bank account information for the purposes of allowing Customers to purchase various items via the Website, including but not limited to, via the “Storefront Login” page of the Website (collectively, the “Online Purchases”). This information is provided directly to such Payment Processors by Customers, and FloWorks does not store this information on its servers or computer systems. Such information is used solely for the purpose of allowing Customers to make Online Purchases.

We also collect personal information (such as contact information) when Visitors provide or request information via the Website. FloWorks will use such personal information for a number of purposes including responding to requests for information. FloWorks will also compile data based on responses received from Visitors in order to allow FloWorks to analyze the experience of Visitors so that FloWorks can improve the services that FloWorks currently offers and to allow FloWorks to predict future services that FloWorks may consider offering. The data which FloWorks compiles from responses received from Visitors to the Website may also be shared with third parties for the same purposes, but the information shared includes no personal identifiable data, so your name and personal information is not provided to such merchants. Visitors that provide or request information via the Website are deemed to agree to this use of data and to consent to receive a response from FloWorks to the email address or other contact information provided to FloWorks. Finally, even if you only browse through the Website and read the information contained on the web pages, FloWorks will nevertheless gather certain information about your visit automatically. This information does not identify you personally, but may, for example, reflect how you found or were directed to or used the Website. The Website automatically gathers your IP address when you use any portion of the Website. It also may collect the name and URL of the Website that you visited immediately preceding your visit to the Website. FloWorks may use this type of non-personal information on a cumulative basis to better understand what pages Visitors and prospective customers access or visit, and FloWorks may disclose this information to business and trade partners as well as companies affiliated with FloWorks.

2. Children’s Information Policy

FloWorks does not knowingly solicit any personal information from children under the age of 13. In the Terms, you represent and warrant that you are at least 18 years of age. If you are under the age of 13, contact a parent or guardian before using this Website and please do not submit any information to FloWorks. If FloWorks is made aware FloWorks has collected personal information from a child under 13 years old in a manner that is inconsistent with the Children’s Online Privacy Protection Act of the United States, then FloWorks will endeavor to delete this information as soon as practicable.

When you visit the Website, FloWorks may place one or more “cookies” on your computer. These are small text files that contain information that allows FloWorks to identify your computer or browser. They allow websites to store information such as user preferences.

In addition, FloWorks uses Google Analytics to analyze the use of this Website. Google Analytics generates statistical and other information about Website use by means of cookies. The information FloWorks collects is used to respond to inquiries, improve the content of the Website, improve the quality of FloWorks’ products and services, and fill open positions within our organizations. The personal information FloWorks collects is not shared with or sold to other organizations for commercial purposes, except when FloWorks has your permission or it is necessary to share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms, or as otherwise required by law.

Other than for the purposes described above or in Section 1, FloWorks does not use your email address or other personal information to send commercial or marketing messages without your consent.

Although FloWorks’ suppliers of web-related services may have access to your personal information, neither FloWorks nor they will send such information to anyone else outside of FloWorks or companies affiliated with FloWorks without your permission.

6. Sharing Information

FloWorks and its licensors own the code, databases, and all rights to the Website and any feedback you provide. As between you and FloWorks, you retain all rights to the personal information you provide to FloWorks through the Website; provided that if you incorporate into feedback any Content, you hereby grant FloWorks a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, and display the Content when operating the Website and for FloWorks’ internal business purposes.

Your contact information may be available to or provided to third-party service providers and contractors (including Payment Processors) as well as affiliates of FloWorks. However, in the case of third-party service providers and contractors (including Payment Processors), they will be required not to use the information except to perform their services to FloWorks. There are certain other exceptions when FloWorks may provide your contact information to third parties:

  • FloWorks may use personal information when investigating and correcting technical problems and malfunctions in the Website or the computer systems that support the Website.

Accordingly, if FloWorks merges with another entity or if FloWorks sells FloWorks’ assets to another entity (collectively referred to as a “Transfer”), FloWorks’ contact lists and information, which may include personal information you have provided FloWorks, would be included among the assets that would be transferred and FloWorks would request that the entity treat your information in accordance with these terms. FloWorks makes no guarantee as to whether such entity will treat your information in accordance with these terms and disclaims any liability arising out of such entity’s failure to do so.

Although FloWorks takes reasonable measures to ensure the security of the data you may choose to provide FloWorks from loss or misuse, unfortunately the transmission of data through the Internet cannot be guaranteed to be 100% secure. Neither FloWorks, nor companies affiliated with FloWorks, nor any of their respective employees, officers or agents or the provider of the internet services on behalf of FloWorks or the creator of the Website can give any representation or warranty as to the absolute security of the data transmitted using the Website and cannot give any guarantee that such data will not be compromised by bad actors. If you choose to provide data to or allow collection of data by FloWorks or any companies affiliated with FloWorks or any of their respective officers, directors or employees or agents, then you do so understanding your own risk.

This Website contains links to other websites that are not maintained or controlled by FloWorks. FloWorks is not responsible for the privacy practices of such other websites, and you are encouraged to review their privacy policies (if any). The policies and procedures FloWorks describes here do not apply to third-party websites.
